Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Holarctic (“Holarctic,” “we,” “us” or “our”). By using holarctic.com, submitting a form, or receiving messages from us, you agree to these Terms. If you do not agree, please do not use the site or opt in to our messages.

You may use this site for lawful purposes only. You agree not to interfere with the site, attempt to gain unauthorised access to it, submit false information, or use automated means to submit our forms.

The content, design, software, graphics and marks on this site are owned by Holarctic or our licensors and are protected by intellectual property laws. You may not copy or reuse them without our written permission.

Program description

Holarctic operates a text messaging program for people who ask to hear from us. If you provide your mobile number and tick the consent box on one of our forms, we may send you SMS or MMS messages about your enquiry, scheduling and reminders for walkthroughs or appointments, service and account notifications, product updates, and launch announcements.

Consent

You opt in by entering your mobile number and ticking the text message consent box on aHolarctic form. The box is never pre-ticked. Consent to receive text messages is not a condition of any purchase or of receiving any service from us. You may still contact us, request a walkthrough and become a customer without opting in.

Message frequency

Message frequency varies and depends on how you interact with us. Conversational and appointment-related messages are sent as needed. You will not receive more than approximately 10 messages per month from our recurring program.

Fees

Message and data rates may apply. Holarctic does not charge for the messages, but your mobile carrier's standard message and data rates apply to every message sent and received. Check your plan with your carrier.

Opting out

Reply STOP to any message from us to cancel at any time. After you send STOP we will send one confirmation message and then stop sending messages to that number. You can also email hello@holarctic.com to be removed. To rejoin, opt in again through a form on our site.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Supported carriers may change without notice.

Privacy

No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent is not shared with any third parties. We share your number only with the messaging providers and carriers needed to deliver the messages you requested. See our Privacy Policy for full details.

Changes to your number

Tell us if your mobile number changes or is reassigned, so that messages intended for you are not sent to someone else.

If you contact us or ask to be notified at launch, we may email you in reply and about the subject of your enquiry. Every marketing email includes an unsubscribe link, and you can email hello@holarctic.com to opt out at any time.

The site and its content are provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure or error free.

Any figures, metrics or example results shown on this site are illustrative. They are not a promise or guarantee of the results any business will achieve.

To the fullest extent permitted by law, Holarctic is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of your use of the site or our messages. Our total liability for any claim relating to the site is limited to one hundred US dollars (US$100).

You agree to indemnify and hold Holarctic harmless from any claim or demand, including reasonable legal fees, arising from your misuse of the site or your breach of these Terms.

We may update these Terms from time to time. The effective date at the top of this page shows when they last changed. Continuing to use the site or our messaging program after a change means you accept the updated Terms.

These Terms are governed by the laws of the United States and of the state in which Holarctic is established, without regard to conflict of law rules.
